Mumhood - Subscription Terms and Conditions
Please read our Terms and Conditions (the “Terms”) carefully before signing up to subscribe. By signing our Terms, you are confirming that you have read the Terms and agree to be bound by them. These Terms together with the items listed in paragraph 2, below, constitute a subscription contract between you (the “customer”) and us, Mumhood Limited (“MUMHOOD")
In these Terms “we”/”us”/”our” means MUMHOOD and “you”/”your”/”yours” means you, the customer.
Very important: your health and wellbeing
- Please consult with your doctor prior to starting any of our exercise programmes.
- If at any point during any exercise you start to feel faint, dizzy or nauseous please stop immediately.
- You are responsible for exercising within your limits.
- If you are pregnant or are a new mum, you must please take special care and don’t push yourself to exhaustion.
- Make sure you stay hydrated and take breaks whenever you feel it necessary.
DATA PROTECTION NOTICE: We, MUMHOOD (the trading name of Mumhood Limited), will use your personal details and information to provide you with use of our services and facilities, to administer and maintain our subscription records, to process your application and payments, to verify your identity and to carry out market research. We may keep your information for a reasonable period for these purposes. We may share your information with our service providers in order to provide you with the MUMHOOD services, and with other third parties to comply with our legal or regulatory obligations, for the prevention of fraud or other crimes, and in the case of medical emergencies. If your personal details change, if you change your mind about how you wish to be contacted, or if you have any queries about how we use your information, please let us know by contacting firstname.lastname@example.org.
All programmes, equipment, tutorials, exercise guides, workshops and content/resources provided through the MUMHOOD website at www.mum-hood.com (collectively referred to as “Programmes” for the purposes of these Terms) are supplied by Mumhood Limited whose registered office is Unit 1, Luke Street, London, EC2A 4PX, United Kingdom and whose company number is 10229840), subject to the following express Terms.
- Programme contract period
You may sign up for a MUMHOOD Programme either by way of:
an upfront payment which provides you with unlimited access to your selected Programme for a certain number of months (the “Upfront Payment Option”); or
an initial signup fee payment in addition to monthly payments (the “Monthly Payment Option”)
If you sign up to the Upfront Payment Option for any Programme, your subscription will expire at the end of the selected Programme.
If you sign up to the Monthly Payment Option, your contract will be ongoing until the end of the selected Programme until you provide 30 days’ notice that you wish to end the contract.
- Selecting Programmes
Full details and the price of each Programme are available on the www.mum-hood.com (the “Website”). Details of any specific Programme you select will also be emailed to you when your order is confirmed. Programmes provide you access to certain content and materials as well as a number of physical items, which are provided to you as part of your subscription.
- Purchase of other goods/services
MUMHOOD may provide you with the opportunity to purchase physical items such as clothing, equipment and DVDs amongst other items and services such as fitness classes and events in addition to the Programmes (“Other Goods/Services”).
If you wish to purchase such Other Goods/Services then these may be purchased through third party retailers such as www.moveyourframe.com, Amazon and Biletto. The Terms and Conditions on such third party sites shall apply to any such purchases and to the sites themselves.
Payment for Other Goods/Services must be made at the time of booking and can be made online by using a credit card or debit card.
- Booking Confirmation
Your booking for Programmes is not complete until you have received a purchase confirmation from us. You will also receive a confirmation from GoCardless. If you do not receive confirmation please contact us by e-mail at email@example.com. You will also receive a payment confirmation from GoCardless. The payments are based on a Direct Debit system and it can take up to 4 days for your Direct Debit mandate to be set up. Your equipment, nutritional guides and additional parts to the Programme will not be sent out via post, or e-mail, until the Direct Debit mandate has been set up and the first payment taken.
If your Direct Debit mandate is not approved by your bank, we will contact you to let you know and your access to the Programme videos will be suspended until payment is processed.
We will compensate you for any loss or damage you may suffer as a result of a breach of the duties imposed on us by law. However, our liability to you may be mitigated to the extent the loss or damage is attributed to:
Your own fault;
A third party unconnected with the provision of our services; or
Events which we could not have foreseen or avoided even if we had taken all of the responsible precautions our liability to compensate you (other than in the case of personal injury or death caused by our negligence) will be limited to the amount that you have paid to us in the previous 12 months or £100 whichever is the greater having regard to such factors as whether the loss or damage was due to a negligent act or omission by us.
- Programme fee changes
We reserve the right to review and change Programme fees periodically. Your monthly subscription fees will remain the same as you commit to at your subscription start date throughout the contract period that you initially commit to. Once your initial contract period has come to an end, if you continue with your subscription, the subscription fee will be charged at the same rate until you cancel the Programme. The subscription fee is subject to change if you unsubscribe and subscribe again at a later date.
If you opt for the Upfront Payment Option or Monthly Payment Option then you will be required to make your first payment, which will be taken through Go Cardless, as a direct debit from your designated bank account.
All monthly payments thereafter will be paid by monthly direct debit from your designated bank account. Your subscription fees will then be payable each month and will become due on or before the same date each month which will vary depending upon the date you sign up until the end of the Programme.
- Non-payment of programme fees
If your Programme fees become overdue, we reserve the right to refuse you access to the Programme resources on the Website until the overdue sums are paid in full. Should you default on payments to us, we reserve the right to notify the default to a credit reference agency or other third party as part of our efforts to obtain payment from you.
- Cancellation of Programme
Once your Programme comes to an end, the direct debit payments will cease. If you would like to cancel your Programme before its scheduled end date, you must give us a minimum of 30 days’ notice via e-mail to firstname.lastname@example.org. Where you serve such notice your Programme will continue for at least 30 days and then end on the day of the month that corresponds to the date you signed up.
You are eligible for a refund if you cancel your subscription within 14 days from the date of transaction, provided that you have not accessed or started downloading any online content and have kept any physical items we have sent you in their original condition, unworn and in their original packaging.
In order to receive your refund you must please return any physical items we have sent you as part of your subscription to the following address (at your own cost): 27 Beethoven Street, Queens Park, London, W10 4LG.
Delivery of your equipment will be via DPD once your initial payment has been taken via GoCardless (which can take up to 5-6 days to process after your mandate request). DPD will send you an e-mail which will give you the option to choose a delivery window. You will also receive an e-mail from Mumhood Ltd. to confirm your equipment has been sent. We provide delivery via DPD, the cost of which is included in the price of your programme. We provide delivery only to the UK (England, Wales, Scotland). If you live outside this area, please contact email@example.com to discuss a specific delivery and to make additional payment if necessary.

- Force Majeure
We shall not be liable to you or deemed to be in breach of these terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these Terms if the delay was due to any cause beyond our reasonable control, including, but not limited to, acts of god, terrorism, explosion, flood, storm, fire, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T, viruses, difficulties in obtaining raw materials, labour, fuel, parts or machinery, power failure or breakdown in machinery.
No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms will operate as a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver, to be effective, must be in writing.
If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.
- Entire Agreement
These Terms together with our disclaimer and any policies we have in force from time to time constitute the entire agreement between us and you and shall have effect to the exclusion of any other memorandum, agreement, or understanding of any kind, whether oral or written, between us and you.
- Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with English law and the parties hereby agree to submit the exclusive jurisdiction of the English courts.
